Where can I locate the Virginia Liquid Nicotine and Nicotine Vapor Product Directory?

The directory became available for viewing on December 31, 2025 and is located on the Office of the Attorney General’s website.

I have more than one product that needs to be certified, do I need to do a separate application for each product?

Yes. If you are submitting more than one product, it is required that a separate application be completed and submitted for each product. (i.e. if you have 10 products you need to submit for certification, you must complete 10 separate applications).

What products are eligible for inclusion in the Liquid Nicotine/Nicotine Vapor Product Directory?

Three categories of Liquid Nicotine and Nicotine Vapor Products (LN/NVP) are currently eligible for certification and inclusion in the directory. LN/NVP for which the manufacturer received a marketing authorization or similar order from the U.S. Food and Drug Administration (FDA) pursuant to 21 U.S.C. §387j by December 31, 2025 are eligible for inclusion in the directory. In addition, LN/NVP that were marketed in the United States as of August 8, 2016 are also eligible for inclusion. Finally, LN/NVP for which a manufacturer submitted a premarket tobacco product application (PMTA) to the FDA pursuant to 21 U.S.C. §387j on or before September 9, 2020, where such application remains under review by the FDA, or a final decision on the application has not otherwise taken effect, are eligible for certification and inclusion in the directory.

I have additional products to certify for inclusion in the Liquid Nicotine/Nicotine Vapor Product Directory. Can I submit additional certifications?

The Office of the Attorney General is currently unable to accept new certifications for liquid nicotine and nicotine vapor products. Per Va. Code § 59.1-293.16, certification forms were due by December 31, 2025. Certifications submitted after December 31, 2025 will be returned to the manufacturer.

Where can I find the forms to renew my liquid nicotine and nicotine vapor product certifications?

Our office is not currently processing renewal certifications for liquid nicotine and nicotine vapor products at this time. Information regarding the recertification process required by Va. Code § 59.1-293.16 will be made available after July 1, 2026.

I have questions about how the new vaping laws work; I don’t understand the Va. Code § 59.1-293.15 et seq., is the LN/NVP Compliance Unit able to assist me interpret this legislation?
