Approval of Performance and Payment Bonds
The Office of the Attorney General reviews payment and performance bonds for public construction projects. Agencies should request approval of project bonds as soon as possible following receipt of the executed bonds and project contract from a contractor.
The OAG requires the following information for bond approval:
- The fully executed payment and performance bonds, signed in blue ink;
- The fully executed and completed Affidavit and Acknowledgment of Attorney in Fact that accompanies each bond; and
- The contract to which the bonds relate.

The OAG requests not less than 10 business days to complete the review. Agencies should consider this when planning their timelines. We will make every effort to complete reviews as quickly as is practicable.
